1. Definitions & Interpretation:
Client – Any individual receiving services from the provider.
Provider – The Power of Passion With Purpose Pty Ltd.
Services – All coaching, support, Support Coordination, trauma recovery, NDIS and non-NDIS programs offered by the provider.
NDIS – National Disability Insurance Scheme.
Supports – Funded or private services provided to clients.
Confidential Information – Personal, sensitive, or private information shared in the course of services.
2. Terms & Conditions of Service:
2.1 Purpose & Scope
These terms govern all services provided by The Power of Passion With Purpose Pty Ltd, including NDIS-funded and privately funded services.
2.2 Eligibility
Clients must be 18 years or older, or represented by an authorised legal guardian.
2.3 Services & Booking
Services are delivered as agreed and are subject to availability, suitability, and client needs.
2.4 Fees, Payment & Invoicing
Private clients: Fees are pre-paid or payable within 14 days of invoice.
NDIS clients: Fees align with plan manager arrangements or NDIS Pricing Arrangements.
Late payments may incur interest.
2.5 Cancellations & Refunds
24–48 hours notice is required for cancellations.
Late cancellations or no-shows may incur full fees.
2.6 Client Responsibilities
Provide accurate and up-to-date information.
Communicate changes in circumstances promptly.
Behave respectfully and safely during sessions.
2.7 Provider Rights
Deliver services professionally and safely.
Refuse or withdraw services if necessary for safety, compliance, or suitability.
2.8 Intellectual Property
All content, materials, and resources provided by the provider remain their intellectual property unless otherwise agreed in writing.
2.9 Confidentiality & Privacy
Both parties agree to maintain confidentiality. Information will only be disclosed where legally required or with consent.
2.10 Liability & Insurance
Liability is limited to fees paid for services. The provider is not liable for indirect or consequential loss. Professional indemnity and public liability insurance are maintained.
2.11 Termination
14 days written notice is required to terminate services.
Immediate termination may occur for serious breaches, unsafe behavior, or non-payment.
2.12 Dispute Resolution
Disputes will first be addressed through direct discussion. If unresolved, escalation may occur via external bodies.
2.13 Governing Law
These terms are governed by the laws of Queensland, Australia, or applicable state law.
2.14 Notices
Written notices may be delivered via email or post to the registered address of either party.
3. Privacy Policy:
3.1 Introduction
The provider complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
3.2 Information Collected
Contact details
Health, trauma, and NDIS plan information
Session notes, communications, and progress records
3.3 Use of Information
Information is used for service delivery, billing, reporting, and legal compliance.
3.4 Storage & Security
All information is stored securely and retained in accordance with legal requirements.
3.5 Disclosure
Information may only be shared with necessary third parties (e.g., plan managers, legal bodies) or with client consent.
3.6 Rights to Access
Clients may request access to or correction of their personal data.
3.7 Complaints
Privacy complaints may be submitted in writing or escalated to the OAIC if unresolved.
3.8 Updates
The provider may update the privacy policy and will notify clients of significant changes.
4. Service Agreement (NDIS & Non-NDIS Clients):
4.1 Parties
This agreement is between the client (or their authorised representative) and the provider.
4.2 Services & Schedule
All services, including frequency and rates, will be documented in a Schedule of Supports or Service Plan.
4.3 Roles & Responsibilities
Provider: Deliver services professionally, meet legal obligations, and report progress.
Client: Provide accurate information, pay invoices, and communicate needs or changes.
4.4 Payments
Fees are determined based on private arrangements or NDIS pricing, payable according to agreed terms.
4.5 Changes & Termination
Either party may request changes or terminate services with 14 days written notice.
4.6 Disputes & Complaints
Clients are encouraged to follow the provider’s internal complaints process first. NDIS clients may escalate to the NDIS Commission if unresolved.
4.7 Privacy & Recordkeeping
All privacy obligations apply; records are retained securely and only shared with consent or as legally required.
